Objectives
By the end of the course you will be able to
- understand your duties and responsibilities under the Mental Capacity Act (MCA)
- learn how to apply the 5 principles of the MCA in clinical practice
- understand the ‘decision/time specific’ nature of mental capacity
- understand the assessment of capacity and standard for best interests decisions
- learn when to apply for an Independent Mental Capacity Advocate (IMCA)
- learn about the use restraints, restrictions and less restrictive options, and evidencing the use of restraints under the MCA
- learn about Court Appointed Deputies, Lasting Powers of Attorney and the implications for clinical practice
- learn about what constitutes a deprivation of liberty as per the ‘acid test’.
