Objectives

By the end of the course you will be able to

  • understand your duties and responsibilities under the Mental Capacity Act (MCA)
  • learn how to apply the 5 principles of the MCA in clinical practice
  • understand the ‘decision/time specific’ nature of mental capacity
  • understand the assessment of capacity and standard for best interests decisions
  • learn when to apply for an Independent Mental Capacity Advocate (IMCA)
  • learn about the use restraints, restrictions and less restrictive options, and evidencing the use of restraints under the MCA
  • learn about Court Appointed Deputies, Lasting Powers of Attorney and the implications for clinical practice
  • learn about what constitutes a deprivation of liberty as per the ‘acid test’.
